Actually saw a policy statement from Karen over at NSI (the InterNIC,
as it's more commonly known) about domain names and copyrights - the InterNIC
doesn't make a stand regarding ownership of trademarks or copyrights, it just
registers, and allows people to settle such issues with the court system.
Usually it turns out to be cheaper to just buy the domain or even the company
registering it, in practice. But it's hillarious to watch.

That was the policy for several years, but I think they changed it after a
fight with McDonald's lawyers.

The report I heard, at the time their policy was changing, indicated that at
least in many cases they wouldn't take a position on who owned the rights to
a name ... but they wouldn't let you keep one that was challenged, either,
unless you contracted to pay for their legal defense if they were sued.
(There *must* be some mechanism for deciding that some challenges are merely
petty harrassment, I'd guess.) They may well have made further changes since
then - this was last fall, I think.

Wow. You'd think that sort of policy would lead to a lot of frivolous
challenges. I'd imagine most small companies with domain names would decide
it was easier to change domain names than to commit to spending a lot of money
on it.
