I think that, although it is illegal and should be illegal to pass or sell
illegal roms, there is really no way for ne1 to rule against emulators b/c
of their use as a legal testing tool.

Actually, game makers don't complain as much if the games are no longer being
made. After all, they'd certainly not be losing any money! Systems such as
the NES, Colecovision and others that are no longer in production are on the
border line of legality. Most places (like emux.com) suggest that it's only
legal to dl the ROM's if you actually *OWN* the cartridge. The emulators can
be justified on the basis that the systems and games are fragile and won't
be around forever. The emulator and ROM can preserve this gaming history.
If that's the price to keep the classics around, then I vote for it.

Actually it is legal to use emulators as long as you own the device you are
emulating

In my opinion, its alright to use emulators and ROMS if the system is no
longer being made.

I was told that the wii will have downloads for older Nintendo games,
and that they are more integrally sound than the ROM versions.
It will be interesting to see how this effects ROMs in the future.
